Amendment to Rule 3.8 of Rules of Professional Conduct

By Order dated December 1, 2005, the Supreme Court amended Comment [4] to Rule 3.8 of the Rules of Professional Conduct, Rule 407, SCACR, by deleting the final sentence of the comment which stated a prosecutor is required to obtain court approval for the issuance of lawyer subpoenas in grand jury and other criminal proceedings after an opportunity for an adversarial hearing is afforded.

In recognition of the devastation and disruption of daily life suffered by the residents of Louisiana, Mississippi and Alabama as a result of Hurricane Katrina, the Supreme Court has issued an order relaxing rules for admission pro hac vice and for admission to the practice of law in the State of South Carolina for lawyers admitted to practice in those states, and who have been displaced due to Hurricane Katrina.
